The Official Information Act

Under the Official Information Act 1982(external link) (OIA) New Zealanders can request official information held by public agencies, including the Ministry of Transport. You can ask for:

  • access to any specified official information the Ministry of Transport holds
  • reasons for decisions made about you
  • internal policies, principles, rules or guidelines
  • meeting agendas and minutes of public bodies, including those not open to the public.

Before you make an OIA request

Which is the right agency?

The Ministry of Transport can only answer requests for information that it holds. If you believe a different agency holds the information you are looking for, please request the information from that agency. To help you:

Your request should be as clear and specific as you can possibly make it.

We will acknowledge your request, usually within 24 hours, and respond no later than 20 working days after we receive it. In some circumstances it may take longer. If we require an extension we will contact you and tell you why it is necessary.

 

Withholding information

The OIA says information should be made available unless there is good reason to withhold it. We may only withhold information for specific reasons set out in the Act. If this occurs, we will let you know why.

 

Complaints

If you are not satisfied with our response to your request you may wish to contact us in the first instance to see if we can resolve the issue.

You can make a complaint to the Office of the Ombudsman(external link) if you:

  • have concerns regarding the decision we made on your request
  • are unhappy about the way your request was treated or processed.

The Office of the Ombudsman can investigate and review our decision and may make a recommendation to us if it is considered appropriate

 

Publishing OIA responses

The Ministry of Transport publishes selected OIA responses when the information is likely to be of public interest. We do not publish information that is governed by the Privacy Act 1993.
